Welcome to CollegeTalk ("CollegeTalk," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the CollegeTalk website, applications, and related services (collectively, the "Services") operated by CollegeTalk LLC.

CollegeTalk provides a platform that connects prospective college students with verified current college students for paid one-on-one conversations regarding college experiences, academics, campus life, and related topics.

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and any additional policies or guidelines referenced within them, including our Safety Guidelines available through the CollegeTalk platform.

If you do not agree with these Terms, you may not access or use the Services.

1. Description of Services

CollegeTalk is an online platform designed to help prospective college students connect with current college students who can share their personal experiences, insights, and perspectives regarding college life.

CollegeTalk facilitates connections between users but does not provide academic, admissions, financial, legal, or professional counseling services.

College students participating on CollegeTalk share their own personal experiences and opinions. Their statements represent their individual perspectives and should not be interpreted as official statements, recommendations, or representations from their college, university, or CollegeTalk.

2. Eligibility and Age Requirements

You must be at least 16 years old to create an account or use the Services.

By using CollegeTalk, you represent and warrant that:

  • You are at least 16 years old.
  • You have the legal capacity to agree to these Terms.
  • All information you provide is accurate and complete.
  • You will maintain accurate information throughout your use of the Services.

If we discover that an account was created by an individual who does not meet the minimum age requirement, we may suspend or terminate that account.

Parent and Guardian Participation

Parents and legal guardians may create or assist with an account on behalf of a prospective student who is eligible to use CollegeTalk.

Parents and guardians may participate in video interviews alongside the prospective student. However, interviews are limited to one device per session. A parent or guardian participating in an interview must do so by joining the session alongside the prospective student on the same device.

Parents and guardians are responsible for ensuring that use of the Services by a minor complies with applicable laws and these Terms.

3. Accounts

To access certain features of CollegeTalk, you must create an account and provide accurate information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • Providing accurate account information.
  • Updating your information when it changes.
  • All activity that occurs through your account.

You may not share your account credentials with another person or allow another person to access your account in a manner that violates these Terms.

CollegeTalk may require email verification or additional verification steps before allowing full access to certain features.

Account Types

CollegeTalk currently offers two primary account types:

  • Prospective Student Accounts: Accounts for individuals exploring colleges and seeking conversations with current college students.
  • College Student Accounts: Accounts for current college students who have completed CollegeTalk's verification process and wish to offer paid conversations.

Each account type may have different features, requirements, and responsibilities.

4. Prospective Student Accounts

Prospective students using CollegeTalk may be required to provide information including:

  • Age
  • Intended major
  • Application status
  • State of residence
  • Interests
  • Optional profile information

Prospective students agree that information provided through the Services will be accurate and not misleading.

Prospective student profiles are not publicly searchable and are not intended to be visible outside the CollegeTalk platform.

During interviews and related interactions, a prospective student's first name, last initial, and optional profile photo may be visible to the participating college student.

5. College Student Accounts

College students may use CollegeTalk to provide personal experiences and opinions to prospective students through paid conversations.

College students may create profiles containing information such as:

  • College or university
  • Major and optional minor
  • Year in school
  • Biography
  • Interests
  • Clubs and organizations
  • Profile photo
  • Introduction video
  • Availability
  • Interview pricing

College students are responsible for keeping profile information reasonably accurate and updated, including information regarding their school, major, and current student status.

College students understand that their profiles are intended to help prospective students learn about their personal experiences. CollegeTalk does not guarantee that any information provided by a college student represents the views or policies of that student's university.

6. College Student Verification

To maintain trust and authenticity within the CollegeTalk platform, college students must complete a verification process before offering interviews.

The verification process may require information including:

  • Proof of current enrollment.
  • An active educational email address.
  • An academic transcript.
  • Profile information.
  • Introduction video.
  • Other information reasonably necessary to verify student status.

CollegeTalk reviews verification information manually or through reasonable verification procedures. Verification confirms that a user has provided sufficient information to demonstrate student status. Verification does not mean that CollegeTalk guarantees the accuracy of all statements made by a college student, the quality of their advice, or their suitability for a particular prospective student.

CollegeTalk may approve, reject, suspend, or remove a college student account at its discretion when necessary to maintain the safety, integrity, and reliability of the platform.

Verification Failures and Misrepresentation

If CollegeTalk determines that a college student has provided false, misleading, or fraudulent information during verification or while using the Services, CollegeTalk may immediately suspend or terminate the account.

This may include:

  • False claims regarding enrollment or university affiliation.
  • Altered or fraudulent verification documents.
  • Misrepresentation of academic information.
  • Attempts to bypass the verification process.

If a verification application is rejected, CollegeTalk may provide the applicant with a reason for rejection and allow the applicant to correct issues and resubmit verification materials where appropriate.

If an account is suspended or terminated due to intentional fraud or misrepresentation, CollegeTalk may forfeit unpaid balances or pending payments associated with that account where permitted by applicable law.

7. College Student Independence and University Disclaimer

College students using CollegeTalk participate independently and voluntarily. College students are not employees, contractors, agents, representatives, or spokespersons of CollegeTalk.

College students are also not representatives, employees, agents, or official spokespersons of their colleges or universities.

CollegeTalk has no partnerships, affiliations, endorsements, official relationships, or institutional connections with colleges or universities unless explicitly stated by CollegeTalk.

Information shared by college students reflects their own personal experiences, knowledge, and opinions. CollegeTalk does not verify or guarantee the accuracy of every statement made during interviews.

Prospective students should independently verify important information with official university sources before making decisions regarding college enrollment, applications, finances, or other significant matters.

8. Interviews and Video Sessions

CollegeTalk facilitates online conversations between prospective students and verified college students through third-party video technology providers.

By participating in an interview, you agree that:

  • The interview may be conducted through a third-party video platform.
  • Audio and video may be recorded.
  • Interview information may be used to maintain safety, investigate reports, and enforce these Terms.
  • You will behave respectfully and comply with CollegeTalk's safety standards.

Users may not record, copy, distribute, publish, or otherwise misuse interview content outside the intended purpose of the CollegeTalk platform.

Users cannot download interview recordings through CollegeTalk.

Interview Recordings

Interview recordings are created to support platform safety, quality assurance, misconduct investigations, fraud prevention, and enforcement of these Terms.

Recordings are not routinely reviewed by CollegeTalk employees. Access to recordings is limited and generally occurs only when reasonably necessary, including:

  • A user submits a report regarding an interview.
  • CollegeTalk investigates suspected misconduct.
  • CollegeTalk must comply with legal obligations.

Interview recordings are processed and stored through CollegeTalk's third-party video service provider, Daily. CollegeTalk does not operate the underlying video infrastructure used to conduct interviews.

CollegeTalk will not use interview recordings to train artificial intelligence systems without providing additional notice and obtaining appropriate consent.

9. Interview Scheduling, Cancellations, and Attendance

College students may set their availability and choose the interview sessions they are willing to offer. Prospective students may request interviews based on available times and listed pricing.

College students may decline interview requests, change their availability, or request rescheduling when necessary.

Users are expected to attend scheduled interviews on time and participate for the majority of the scheduled session.

Reasonable allowances may be provided for technical difficulties, connectivity issues, or circumstances outside a user's control.

If an interview cannot be completed, users may report the issue through the CollegeTalk platform. CollegeTalk may review relevant information, including available recordings and session data, to determine an appropriate resolution.

Missed Interviews

If a prospective student attends an interview but the college student fails to participate or does not complete the session as required, the prospective student may receive returned credits.

If a college student attends the scheduled interview but the prospective student fails to participate, the college student may still receive payment where the requirements for an eligible completed session are satisfied.

CollegeTalk may evaluate attendance disputes individually based on the available information.

10. Credits, Payments, and Payouts

Prospective students may purchase CollegeTalk credits that can be used to book interviews with college students.

Credit pricing may generally correspond to United States dollar values, but credits are only usable within the CollegeTalk platform and do not represent currency, stored cash value, or ownership rights.

Credits:

  • Cannot be transferred between users.
  • Cannot be exchanged for cash.
  • May only be used for eligible CollegeTalk services.

College students determine their own interview pricing and availability. CollegeTalk does not guarantee that a college student will receive interviews, income, or any minimum amount of earnings.

Payments to college students are processed through Stripe. CollegeTalk does not store complete payment card information.

CollegeTalk may recommend that college students withdraw accumulated balances in larger amounts when possible because multiple small transactions may result in higher transaction-related fees.

11. Refunds and Credit Returns

CollegeTalk aims to provide a reliable experience for all users. Refunds and adjustments are generally provided in the form of CollegeTalk credits unless otherwise required by applicable law.

Prospective students may receive returned credits when an interview cannot be completed due to circumstances attributable to the college student, including when the college student fails to attend the scheduled session.

Credits are not generally refunded for completed interviews, changes of mind, or dissatisfaction based solely on a college student's personal opinions or experiences.

CollegeTalk may review individual situations involving technical issues, misconduct, scheduling problems, or other circumstances and determine an appropriate resolution.

CollegeTalk reserves the right to modify credit policies, expiration policies, or refund procedures in the future by updating these Terms or providing notice through the Services.

12. Ratings and Reviews

After eligible interviews, users may have the ability to submit ratings and reviews regarding their experience.

Reviews are intended to provide helpful feedback and improve trust within the CollegeTalk community.

When submitting a rating or review, you agree that:

  • Your review will be based on your genuine experience.
  • You will not submit false, misleading, or fraudulent reviews.
  • You will not use reviews to harass, threaten, discriminate against, or target another user.
  • You will not include illegal, obscene, or inappropriate content.

CollegeTalk may remove reviews that violate these Terms, including reviews containing harassment, threats, discriminatory content, obscene material, or other prohibited content.

Users who believe a review is inaccurate or violates these Terms may contact CollegeTalk support for review.

13. User Content and Profile Information

Users may provide content through the Services, including profile information, photos, videos, biographies, interests, reviews, and other materials ("User Content").

You retain ownership of your User Content. However, by submitting User Content to CollegeTalk, you grant CollegeTalk a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, store, reproduce, display, format, and distribute that User Content solely as necessary to operate and provide the Services.

This license allows CollegeTalk to display college student profiles to authenticated users, provide platform functionality, and maintain the operation of the Services.

CollegeTalk does not obtain ownership of your User Content and does not claim that User Content represents the views or opinions of CollegeTalk.

User Content Requirements

You are responsible for ensuring that your User Content:

  • Is accurate and not intentionally misleading.
  • Does not violate the rights of another person or organization.
  • Does not contain unlawful, harmful, abusive, or discriminatory material.
  • Does not misrepresent your identity, education, or affiliations.

College students are responsible for ensuring that information displayed on their profiles remains reasonably accurate, including their college, university, major, year in school, and related information.

14. Prohibited Activities

You agree not to use the Services to:

  • Provide false information or impersonate another person.
  • Misrepresent enrollment status, university affiliation, academic information, or qualifications.
  • Harass, threaten, intimidate, discriminate against, or harm another user.
  • Share another user's personal information without permission.
  • Record, copy, distribute, or misuse interviews outside the intended purpose of the Services.
  • Attempt to move payments or transactions outside of CollegeTalk.
  • Scrape, collect, or copy user profiles or platform information without permission.
  • Attempt to bypass security features or access restricted areas of the platform.
  • Upload malicious software, harmful code, or content designed to disrupt the Services.
  • Use the Services for unlawful purposes.

Violations of these restrictions may result in suspension, termination, removal of content, loss of access to Services, or other appropriate actions.

15. Safety and Reporting

CollegeTalk is designed to provide a safe environment for prospective students and college students to communicate.

Users must follow CollegeTalk's safety standards and guidelines available through the platform.

Users should report behavior that may violate these Terms, including:

  • Harassment or inappropriate conduct.
  • Fraudulent behavior.
  • Misrepresentation of identity or student status.
  • Safety concerns.
  • Violations of platform rules.

When reviewing reports, CollegeTalk may examine relevant information including interview recordings, account information, messages, scheduling information, and other available data related to the report.

CollegeTalk may take actions it determines appropriate, including warnings, content removal, account restrictions, suspension, or termination.

16. Intellectual Property Rights

The CollegeTalk Services, including the website, applications, software, design, branding, logos, features, text, graphics, and other materials created or provided by CollegeTalk are owned by CollegeTalk LLC or its licensors.

Except as expressly permitted by CollegeTalk, you may not:

  • Copy, modify, distribute, or reproduce CollegeTalk materials.
  • Reverse engineer or attempt to extract source code from the Services.
  • Scrape, collect, or create competing databases using CollegeTalk content.
  • Use CollegeTalk branding without written permission.

Third-party services integrated into CollegeTalk, including video technology and payment services, remain owned by their respective providers.

17. Third-Party Services

CollegeTalk relies on certain third-party services to provide functionality within the platform. These services may include payment processing, video conferencing, cloud infrastructure, and other technology services.

By using CollegeTalk, you acknowledge that certain portions of the Services may be provided through third-party providers and that your use of those services may be subject to additional terms and policies established by those providers.

Third-party providers used by CollegeTalk may include:

  • Stripe: Payment processing and college student payouts.
  • Daily: Video conferencing and interview recording infrastructure.
  • Other service providers necessary to operate and maintain the Services.

By accepting these Terms and using the Services, you acknowledge and agree that certain third-party services may process information necessary to provide their functionality.

CollegeTalk is not responsible for the independent actions, policies, security practices, or availability of third-party services.

18. Artificial Intelligence Restrictions

CollegeTalk recognizes the importance of protecting user interactions and maintaining trust within the platform.

CollegeTalk will not use interview recordings to train artificial intelligence systems without providing additional notice and obtaining appropriate consent.

CollegeTalk may use automated tools or technologies for purposes such as:

  • Security monitoring.
  • Fraud prevention.
  • System reliability.
  • Platform operations.

Any future use of interview recordings or similar sensitive content for additional purposes will be handled through updated disclosures and, where required, additional user consent.

19. No Guarantee of Outcomes

CollegeTalk provides a platform for users to communicate and exchange personal experiences. CollegeTalk does not guarantee any specific outcome from using the Services.

CollegeTalk does not guarantee:

  • Admission to any college or university.
  • Acceptance into a specific academic program.
  • Accuracy of statements made by individual college students.
  • A particular interview experience, opinion, or recommendation.
  • Availability of specific college students or interview times.

Users are responsible for making their own decisions and should independently research important academic, financial, and admissions-related information.

20. Disclaimers

The Services are provided on an "as available" and "as is" basis to the maximum extent permitted by applicable law.

CollegeTalk does not guarantee that:

  • The Services will always be available, uninterrupted, or error-free.
  • Information provided through the Services will always be complete or accurate.
  • The Services will meet every user's expectations.
  • Users will have positive experiences with every interaction.

CollegeTalk is not responsible for statements, opinions, advice, or information provided by users, including college students participating in interviews.

CollegeTalk does not provide official guidance on behalf of any college, university, admissions office, or educational institution.

21. Limitation of Liability

To the maximum extent permitted by applicable law, CollegeTalk LLC and its owners, employees, affiliates, partners, licensors, and service providers will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Lost profits, lost opportunities, or loss of data.
  • Decisions made based on information obtained through the Services.
  • Interactions between users.
  • Actions or omissions of third-party service providers.

To the maximum extent permitted by law, CollegeTalk's total liability arising out of or relating to the Services will not exceed the amount paid by you to CollegeTalk during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions may not allow certain limitations of liability. In those cases, limitations will apply only to the extent permitted by applicable law.

22. Indemnification

You agree to defend, indemnify, and hold harmless CollegeTalk LLC and its owners, officers, employees, affiliates, partners, licensors, and service providers from claims, damages, liabilities, losses, expenses, and costs (including reasonable legal fees) arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your User Content.
  • Your violation of another person's rights.
  • Your conduct during interactions with other users.

23. Suspension and Termination

CollegeTalk may suspend, restrict, or terminate your account or access to the Services when reasonably necessary to protect the platform, users, or comply with legal obligations.

Reasons for suspension or termination may include:

  • Fraudulent activity.
  • Misrepresentation of identity, enrollment, or qualifications.
  • Harassment, abuse, discrimination, or unsafe behavior.
  • Violation of these Terms or platform guidelines.
  • Attempts to misuse or compromise the Services.

CollegeTalk may take these actions with or without prior notice when necessary to protect users or the integrity of the platform.

Termination does not eliminate obligations that arose before termination, including obligations relating to intellectual property, liability, or disputes.

24. Account Deletion

Users may request deletion of their CollegeTalk account by contacting us using the contact information provided below.

When an account deletion request is received, CollegeTalk will take reasonable steps to remove or anonymize personal information associated with the account, subject to legal, security, fraud prevention, and operational requirements.

Following a deletion request, CollegeTalk may retain certain information for a limited period when reasonably necessary to:

  • Comply with legal obligations.
  • Investigate or resolve disputes.
  • Investigate reports of misconduct.
  • Prevent fraud or abuse.
  • Enforce these Terms.

CollegeTalk generally retains necessary information for up to thirty (30) days after a deletion request when needed to allow for legitimate investigations, including law enforcement requests or platform safety matters.

Some information may remain temporarily within backup systems or archived systems before permanent deletion.

25. International Users

CollegeTalk is operated from the United States and provides Services to users located in multiple jurisdictions.

If you access or use CollegeTalk from outside the United States, you understand that your information may be transferred to, processed in, and stored in the United States or other locations where CollegeTalk or its service providers operate.

Data protection laws may differ between jurisdictions. By using the Services, you acknowledge that your information may be handled in accordance with the applicable laws and practices described in our Privacy Policy.

26. Changes to These Terms

CollegeTalk may update these Terms from time to time to reflect changes to the Services, technology, business practices, legal requirements, or other factors.

When changes are made, CollegeTalk will update the "Effective Date" displayed at the top of these Terms and may provide additional notice through the Services or by email where appropriate.

Your continued use of CollegeTalk after updated Terms become effective means that you accept the revised Terms.

If you do not agree with updated Terms, you must stop using the Services.

27. General Terms

Entire Agreement

These Terms, together with the Privacy Policy and any additional guidelines or policies referenced within the Services, constitute the entire agreement between you and CollegeTalk regarding your use of the Services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

CollegeTalk's failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it later.

Assignment

You may not transfer or assign your rights or obligations under these Terms without CollegeTalk's prior written consent. CollegeTalk may assign these Terms in connection with a merger, acquisition, financing, sale of assets, or other business transaction.

College students participate independently and provide personal opinions rather than official university guidance. CollegeTalk does not represent, partner with, or speak on behalf of any college or university.
